These Terms of Service ("Terms") are a customer-facing summary of, and incorporate by reference, the full Master Service Agreement (MSA), which governs your subscription to ANQA RMS OS (the "Service") in full legal detail. Where this page and the MSA conflict, the MSA controls.

1. Acceptance of terms

By accessing anqaos.com or creating an ANQA RMS OS account, you agree to these Terms and the Master Service Agreement. If you do not agree, do not use the Service. If you are signing up on behalf of a hotel or organization, you represent that you are authorized to bind that organization, and "you" below refers to that organization (the "Subscriber") as well as to you personally.

2. Use license

We grant you a non-exclusive, non-transferable license to use the Service for your hotel's own internal business. You may not resell, sublicense, or redistribute the Service, and may not reverse-engineer or attempt to extract its underlying algorithms. See MSA Section 2 for the full grant, restrictions, and open-source component disclosures.

3. Your responsibilities

You are responsible for the accuracy of data you upload, for keeping your Authorized Users' credentials secure, and for your own compliance with data-protection, consumer-protection, and competition law applicable to your operations. You must not use the Service unlawfully, attempt unauthorized access, or resell our recommendations or competitor data as your own service. See MSA Section 4.

4. Fees & billing

Current published pricing: Starter — AED 1,499/month, Growth — AED 2,899/month, Enterprise — from AED 4,500/month (custom quote). A one-time onboarding fee of AED 3,500 (data migration, compset setup, and training) applies on the first paid invoice. Annual plans are billed for 10 months (2 months free). New hotels get a 90-day free trial. Paid subscriptions renew automatically each billing period; cancel any time from your billing settings to stop future renewals. Fees are non-refundable for a partial period. Failed renewal payments get a 14-day grace period before the account steps down to the restricted Free tier. See MSA Section 5.

5. Term & cancellation

Your subscription runs month-to-month (or annually, if you choose an annual plan) from acceptance. Cancel any time; cancellation takes effect at the end of the current billing period, with no refund for the unused portion. See MSA Section 6 for termination for cause and the effect of termination on your data.

6. Forecast disclaimer

FORECASTS AND RECOMMENDATIONS ARE INDICATIVE ONLY. ANQA MAKES NO WARRANTY REGARDING THEIR ACCURACY. YOU ASSUME FULL RESPONSIBILITY FOR THE REVENUE CONSEQUENCES OF IMPLEMENTING ANY ANQA RECOMMENDATION. THE SERVICE NEVER CHANGES YOUR PUBLISHED RATES ON ITS OWN.

7. Liability limit

ANQA'S LIABILITY TO YOU IS CAPPED AT THE GREATER OF (A) THE FEES YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) AED 10,000. ANQA IS NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST REVENUE OR LOST BOOKINGS.

8. Data privacy

You own your hotel's data; we process it to provide the Service. As of 2026-07-27, your data is stored on our managed database infrastructure in the AWS Asia-Pacific (Seoul) region — not currently within the UAE (see MSA Section 3 for the residency note and our migration plans). You may request deletion of your personal data within 30 days of termination; we notify you within 72 hours of confirming any unauthorized-access incident. See our Privacy Policy and MSA Sections 3 and 13.

9. Intellectual property

We retain all rights in the Service, including its software and algorithms. Open-source components we use remain subject to their own licenses. Feedback you give us may be used to improve the Service without obligation to you. See MSA Section 12.

10. Third-party services

The Service relies on providers including Supabase, Stripe, Lighthouse, SerpApi, and the OTA/PMS integrations you connect. We are not liable for their outages or failures beyond our own obligations. See MSA Section 14 and Appendix B for the full sub-processor list.

11. Governing law & disputes

These Terms are governed by UAE law (Dubai), unless your Order Form specifies otherwise. Disputes are resolved by good-faith negotiation first, then binding arbitration under DIAC rules in Dubai. See MSA Section 18.

12. Amendments

We may update these Terms or the MSA's Appendices with at least 30 days' written notice. Continued use of the Service after that notice period constitutes acceptance. Material changes to the MSA itself require a new electronic signature from you.
